COZA Rape Scandal: Pastor Fatoyinbo files counter-claim, demands N50m from Busola Dakolo
Pastor Biodun Fatoyinbo of #COZA approached a high court in Bwari on Friday. He explained the reason for the lawsuit in which Timi Dakolo, the famous musician's spouse, was to be revoked on the grounds that he violently abused Busola in 2002.
In a first opposition, the cleric retained that Busola's lawsuit was frivolous and that the Statute had not been granted, with his group of attorneys headed by Dr. Alex Iziyon the Nigerian Senior Advocate.
He argued that all Busola's awards in the CV/2817/18 lawsuit against him were inadmissible.
On 6 September, Ms. Dakolo had in a Summons Writing, alleging that on 23 September 2002 the pastor of the COZA raped her. The complainant also claimed that on 26 September 2002 the accused publicly assaulted her again.
In addition to begging the tribunal to send the defendant on at least two national newspapers and two national TVs for 7 consecutive days a "obviously worded excuse" for her, Mrs. Dakolo asked that the defendant be forced to send an endorsement note to her displaying sincere remorse for his misdeeds.
In addition, she asked for N10 million in the tribunal. ⠀
Pastor Fatoyinbo also retained that the suit was very incompetent in his preliminary opposition.
He also asserted that the tribunal had no authority to hold a frivolous lawsuit that meant "malpable violence of the tribunal."
He informed the tribunal that, after the action, Mrs Dakolo and her lawyer dropped the records to electronic and print media organisations with "the tale of the defendant embarrassing and scandalizing" being commonly spread on the internet.
Consequently, Pastor Fatoyinbo prayed at the Court in his counterclaim to grant the Claimant and the applicant a cost of N50 m, collectively and severally.
